Depends on what you want to find.
Rapidshare is good 'cause it's more an archive than an assortment of files. You'll most likely find old stuff easier on rapidshare than as torrents. The downside is that unless you have a premium rapidshare account, it might become a huge pain in the ass to dl several files. That's thansk to the ticketing system implemented with rapidshare.

When it comes to being tracked or not, you need to open your eyes: no matter what protocol you use, you CAN be tracked whatsoever.

The main point about rapidshare vs. torrents is the fact that you don't share a single bit when downloading from rapidshare (sharing = uploading data being the more severe misdemeanor).
Due to the set-up of the torrent protocol you inevitably share upload data. Thats when they might bust your balls.

Mind that i'm not a legal expert.
