I think the main problem is that American prisons are not humane.
Swedish prisons are more like small dorm rooms. You get a desk, books, a mattress. Thats a prison cell but there are countries that don't have these terrible holding cells that you wouldn't wish for your worst enemy to sit in like what Chemda describes. If prisons were humane or the process by which you take someone in to be arrested and see a judge wasn't this horrible life ruining experience, for instance giving someone complete information so they can call an employer and arrange for their kids to be taken care of. If the CO wasn't a complete inhuman monster, if the whole system for this was different, then I would say sure take in the girl with a 12 year old summons.
But we are so accustomed to the way things are that we don't even think that it could or should be better. Saner. Not a money-making scheme.
