A person can be found NOT GUILTY at a criminal trial bc the burden of proof on the Government is “beyond a reasonable doubt” but that same person can be found GUILTY at a civil trial and have to pay money to the plaintiff bc the burden of proof is “preponderance of the evidence,” which is a much easier burden of proof compared to beyond a reasonable doubt. Preponderance of the evidence means 51%. On the other hand, “beyond reasonable doubt” requires a person be found not guilty even if there is 51% but there is at least one doubt that is reasonable. It isn’t a perfect system but it should provide some comfort that the Government is held to a higher standard than a private citizen seeking a financial remedy for harm inflicted upon them.

Those “bonks and noises” can absolutely show up in the audio. They may not be audible on headphones, but definitely through speakers, as an unexpected, low-frequency WHOMP. Mics pick up everything, and playback doesn’t reproduce or process sound in the same way your own ears do. Our auditory systems have great noise filtering abilities. Digital recording is not so discerning. It captures everything. I appreciate the effort taken to reduce extraneous noise from the shows.

Not as much as I appreciate a good argument on the show, however.
