I actually tried posting before but it said I need to activate my account. I guess Quad or Chemda got me fixed probably.... I originally tried to post a 10 minute excerpt from the Suicidegirls.com podcast about glitter.

Regarding thesimpsonsmovie.com verdict:

Isn't there some sort of ex post facto in this ruling? If he bought the domain name before the law was passed, wouldn't that prevent a WIPO ruling to just "hand it over"?

The Anticybersquatting Consumer Protection Act (also known as Truth in Domain Names Act), a United States federal law enacted in 1999, is part of A bill to amend the provisions of title 17, United States Code, and the Communications Act of 1934, relating to copyright licensing and carriage of broadcast signals by satellite (S. 1948). It makes people who register domain names that are either trademarks or individual's names with the sole intent of selling the rights of the domain name to the trademark holder or individual for a profit liable to civil action. It was sponsored by Senator Trent Lott on November 17, 1999, and enacted on November 29 of the same year.

Keith got the site before that law was in enacted...April 27th, 1999

I don't know. I still think his best defense would be to play the 'white house' angle.

'Simpsons' or 'The Simpsons' is generic enough that it could constitute the umbrella of generality.

Fortunately, there is precedence... opening up my chance of Keith making fun of me on the next show....
(BTW, I'm 5'9 195 LBs, single-hetero, web designer from Niagara Falls Ontario har-har-har)
He could argue that the domain name is generic enough that he has every right to use it.

For example..... I mention 'white house' because www.whitehouse.com use to belong to a porn site. The actual white house was in an out rage because 'white house' was a generic enough term that they couldn't sue... or tried and failed.

Now, I know in the past.. madonna had the same problem.. but she won her case (I think). I don't know about the laws now... but before the 'generic' domain names were very hard won in court cases.

April 27th, 1999 would be before the bill was even proposed to Congress (Introduced June 21, 1999). It appears that if Keith wishes to appeal, he may have a case, as the Constitution protects against ex post facto judgments.
