I understand what you're saying and I do think some lines can be drawn in terms of legislation about what is really wrong and what is just kind of gross- i.e. incest between parent and child which I think is wrong (should be illegal) and incest with your second cousin which I think is just kind of weird.
Also i really don't think people have adult incestuous relationships as often as people smoke pot. I don't think the two are any where near equivalent in terms of what the rates of incarceration would be.
I agree that you can't monitor what people do in the bedroom but you can make certain moral decisions as a society. I don't think this type of situation can be compared to homosexuality or orgies, or bondage or anything that is between two consenting adults. Incest between parent and child (even an their adult child) is a specific and harmful situation and I think its ok as a society to make a judgement call on it. You want to go make out with your second cousin, ok whatever, I wouldn't do it but I don't really care if you do. I think this situation is different.
The real issue is harm. Is there harm being done in this situation? I think yes and therefore it should be legislated against. I don't think smoking marijuana hurts anyone- therefore I don't think our tax dollars should be wasted incarcerating thousands of people on low level drug offenses.
