Chemda asked how the counts work when you were talking about Puck's computer. Two counts: Count 1 - it is illegal to possess child porn and it was found on his computer. Child porn only gets on your computer one of two ways. You went looking for it or you produced it. That leads to Count 2 - it s illegal to seek out child porn.
And about the pleading not guilty thing, a defendant will always plead not guilty at the initial court appearance because there have been no plea negotiations, no viewing of the evidence by the defense, and often times, the defendant does not have an attorney yet. Once that plea is entered the court has to determine if the defendant is a risk to the community or a flight risk. Absent those two things, they can be released on bond.

....also, the number of images found, the content of this images, and how they were received and stored are all enhancements to the sentence a person gets after they plead or are found guilty at trial.
Since they did not charge him with production, it sounds like he was downloading the images from the Internet. |

But yeah it's more comedy to imagine him accidentally putting it on the cloud. |

[QUOTE=Lanfear;853206]And I would assume the police found a child porn site/distribution ring and checked who visited and downloaded stuff from there.
There are a lot of ways police can get probable cause to search his computer. Not the least of which is someone accessing his computer, finding a file marked "not child porn", and ratting him out. |

ooooph
childporn. Hollywood seems to be wrapped up in this like a demonic tentacle when you're rich wouldn't you pay someone else to download that stuff for you? Just say "I'll give you $25,000 a week, download my gross shit at YOUR place, turn off your wifi and give me your laptop for the weekend." |

My understanding is that if you want a reliable source of child porn you have to turn to the "darkweb" utilizing browsers like Tor. Some of the sites that you would download the tor browser from have FBI malware, so as soon as people use the software they popup on a FBI watch list. When the feds kick in your door for child porn, they KNOW whats been going on on the computer its just a matter of finding out if the evidence is still on the computer. That's why you never really hear of cases where the FBI kicks down a door and the person was cleared of all charges.
