Security Cameras
So I was just listening to the Danny Lobell episode 1172 Danny's last Show. Around minute 8-9 Keith Newsy and Chemda are talking about security cameras and how these camera operators are looking for terrorists not to look for people picking their noses, pulling the wedgies out of their butts or tripping and falling....
then there was the water fountain lady... YouTube - Woman Falls Into Fountain at Mall While Texting and Walking Clearly hilarious and clearly Youtube worthy (it went viral over night) but with every action there is a reaction... Woman Falls In Fountain While Texting, Sues - Fox News Latino So, here are a couple of questions, you're caught on camera picking your nose, or that wedgie or tripping into the mall fountain....some bored security guard decides this is is youtube worthy...do you sue? Is this woman overreacting? What are your thoughts on security cameras in every nook and cranny watching your every move?? |

I think in this specific case she's over reacting by suing, because you can't really identify her from the video, so she wouldn't really face any embarassment on the streets, just from family/friends that she likely already told this to as a humorous story. Although, she does have the right to do so, and smelled the dollars. Can't blame her, I'd do the same thing.

She definately has the right to sue; but I think it's ridiculous for her to do so.

The video is the mall's property. In most US jurisdictions, there have to be signs posted in places that use security cameras for the purposes of recording someone's image for said purposes. She's also in a public place where she doesn't have any right to privacy. As previously mentioned, you can't identify her from the video. No one would have known it was her unless she told them, thus no harm came to her reputation or character as a result of it being released.
The same argument could be said for pictures on sites like Funny Pictures at WalMart. As a 6'5" burley, hairy man you went into a Wal Mart dressed as a fairy princess and now you want to sue because someone posted your little fetish on a website and now all your co-workers/friends/family know... PUH-LEEZ. My 2 cents. |

These stories are pretty misleading. The title of the article says that the lady has sued the mall, but there is no mention of any lawsuit other than she has hired a lawyer to look into it. Also, any cause of action she might have will more than likely not have anything to do with her embarrassment. More likely it will have to do with safety and potential harm as there was no rail and the guards were more concerned with laughing than helping. Since she didn't suffer any harm, she probably won't win any money. And as mentioned in the previous post, any harm from embarrassment is self-inflicted. If a lawsuit actually happens, I wouldn't expect more than very minimal money reward and the mall putting some rails up to protect kids or something.
To answer the original questions about what we think about cameras everywhere... I hate it, but also think it's ok. DaHoney is right, we have no expectation of privacy in public. It's just very "Big Brother" to me and sets me on edge. How am I supposed to discreetly fuck someone in a parking lot if I know I'm being recorded???

She can only sue if she has suffered actual meaurable damages as a result of the video being uploaded (she lost her job, etc.). Just being embarrassed is not enough to sue. People are embarrassed all the time. If she were to try to sue, she'd probably have her case dismissed. |

Seriously.
She didn't break a bone, right? Maybe she should sue her phone provider for getting the cell wet, or the mall for putting that water thing in her way. She's a mall employee from what I understand so that wasn't a surprise. This is dumb. |
