TL;DR: Dane agreed to the script, and thinks he won, because he got to make it clear to the audience that he will never make a single effort to apologize, or consider anyone's viewpoint but his own. Personally, I think Louis won for that exact reason.

The way I saw it go down was:

Louis felt legitimately confliced about pursuing Dane. This is shown at the begining of the confrontation when Jim Norton essentially acts as the voice of his hardcore fans, and people like Keith who say "He stole your jokes because he's an asshole! There's no other explanation! Go after him!" He doesn't tell Jim he's wrong, or to just fuck off. He says "Well, I don't know for sure, maybe, but let's see..."

Louis wants to give the guy the benefit of the doubt, even though he knows something is shady. He's not a confrontationalist, and he's not a Larry David who immediately assumes the worst in people. If you pay attention to how Louis reacts to people who screw him over, he always approaches from a point of sympathy and analysis. He always thinks to himself "Wait, is this person really this crazy?" because he's so shocked that people would behave like such assholes, that it's only when he confirms that there is simply no other explanation that he goes "Wow! What an asshole!". And I think this is how he goes about his real life. I think he really asked himself many times over "Is he stealing my jokes? Did he do it on purpose? Is this worth pursuing?" I think in the end, he decided not to pursue it because it would sound incredibly petty to go on TV and start talking smack about Dane. There is no fair and just Comedy Court where you can take another comedian, prove he stole your jokes, and have him punished. Other comics don't give enough of a shit about joke stealing (as Keith has said). So the only way to "try" Dane was in a democratic court of youtube public opinion, and I think Louis knows better than to think he can win in that setting, when Dane has such an incredible legion of mindless fans who care way more about Dane than they do about comedy.

Still for all his waffling, Louis doesn't budge on what we do know to be true. Dane saw him do those jokes, and those jokes were either stolen, or accidentally internalized. There is no other explanation, it's just a matter of which one.

The premise that the show set up for me was: We know 100% that the jokes came from Louis, and Dane saw him perform them. If the jokes were stolen, Dane is an asshole, period. If the jokes were accidentally internalized, Dane is an asshole, but ONLY if he doesn't apologize.

Louis gave Dane multiple chances to apologize. I think the multiple attempts by Louis to extend the olive branch really do reflect what the negotiations of this dialogue were like behind the scenes. Louis tries to give Dane an out on the joke stealing. He tries to bond with him over the itchy asshole problem, which is silly, but the fact that Dane just sighs and changes the topic made him come off like even more of an elitist douche.

Dane rejected any and all chances to make a concession. He never once apologizes, never admits wrongdoing, never takes the out that Louis gave him. Dane essentially denies that he inadvertently "sucked up" Louis' material, but if we know FOR A FACT that he was there at the shows, then the dialogue proves that he was being shady, and wasn't even willing to apologize about it.

To me, that makes Dane come off like the ultimate elitist asshole. If you define victory as "getting an apology from Dane", then you're never going to win, because the whole point of the exchange is to prove that Dane is too arrogant, too elitist, and too much of a hollywood sellout to ever consider apologizing. I saw this episode as Louis saying "Look at how shady this guy is. Look at how forgiving I'm willing to be. Look at how easy I make it for him to just admit a tiny amount of wrongdoing, and look at how much hubris he has, that he can't for a second admit he did anything wrong!" And the fact that Louis got Dane to come on his show and agree to act it all out, just shows how oblivious Dane is to the fact that he looks like an asshole when he doesn't apologize.

Every morning I have to take my roommate's towel off the shower's curtain rod, I never really thought about it before, I also routinely sweep all the dirty dishes off the counter into the sink...somebody might end up dead tonight.

Seriously I don't usually think about it and it doesn't typically bother me, but I'm aware my roommate's a pack rat. I own a love seat that is currently just piled with stuff, I passed it the other day and realized not a single thing on it was mine. But he doesn't mind when I move his stuff, I took his big wok, rice-cooker, and a giant pan down to our basement that had just been taking up counter space, he didn't mind (maybe he didn't notice, hmm). Ironically the last time they had been used was by a guest of mine a few months ago.

Face is the insane one, not me. There's being a neat and tidy person, and then there's you freaking out because I used the "morning coffee spoon" for my yogurt b/c I was unaware that the "morning coffee spoon" exists. To be fair, he never yells at me or anything, but I just sit back and let him clean the way he wants b/c if the towels are crooked or the pillows aren't in the right spot, it's gonna bug him, not me.

When I lived with my parents, my mom said everything I did after I was told once was deliberate disrespect. I forget to turn off the light in my room, she tells me not to do it. I do it again a couple of days later, that's because I consciously did it to disrespect her. Same with dishes and every other little thing. So basically after like 14y/o, I was disrespecting her constantly (according to her).

She somehow manages to function normally in society.

it's relative. if you had more respect for her, the things she said would resonate.

Because in three out of four reasons to use the toilet, a person needs to sit down. And because if I fall into the toilet in the middle of the night Ima cut a bitch. Also, my cats play in the toilet so both lids are down in my house.

Very logical, but I don't think that's really the long and short of it. When I'm at my parents I put the seat down (shared that bathroom with my sister for years, even though neither of us lives there anymore), or really anywhere else I put it down. At my house though, the seat is up, and stays up, male urination is by far the most likely of the 4 reasons that will be going on.

I never did understand the not looking down thing, people seriously don't look down? Even with the horror stories of people cracking tailbones and whatnot. Dudes look down to make sure they don't dribble a little (or atleast they should), women don't look down to make sure they don't injure themselves?

honestly, the issue shouldnt even have been discussed, it wasnt a matter of black, whites or gerys: a person took another person's creative iutputs and people who denied it used to be douches, dane cook fans or people who wanted t0o gain his favour.

if a thing like this happened back when katg started and keith was rightfully talkign about it on air, whoever had any doubt about it wouldve been called out as an asshole.

now its "maybe" or "whatever". i think it's a sign of how people forget, stop caring or never did care from the beginning.

no matter what you do, and how people are disgusted, let enough time go by and everything will be forgiven, and people who stood up for the right side will be derided or stop caring.
